How do I find a divorce lawyer I can depend on?

There are good lawyers and there are bad lawyers when it comes to divorce. Our manual Divorce Tools, Resources and Tricks give you all the information about how to pick the lawyer that will best suit you.

Before you trust any lawyer, to give you legal advice on one of the most important milestones in your life, you will need to put some effort into making the decision. Very seldom do high quality divorce lawyers specialize in handholding, so be sure you are looking for legal advice and not sympathy when you choose your lawyer.

Most of us have never had to ‘pick a lawyer’ to handle issues with such high stakes as divorce, so you would best be advised to learn all you can about what to look for in a lawyer and what to ask a lawyer. We offer a simple to use, but carefully calculated method geared towards this one goal: having the better lawyer when push comes to shove during the divorce settlement.

What kind of child support can I expect to pay or receive?

The amount for child support can be based on your state welfare agency's figures as a reasonable amount to raise a child on as monthly amounts.   You can also use the income and expense figures that you, your spouse, or your accountant may have worked out during the divorce process that you both feel is fair for your situation. The best way is to produce the actual figures as a compelling argument toward setting the amount of monthly child support.

If you have ever heard that the law is blind, it was probably about this: being ordered to pay an impossible monthly amount and being jailed for not doing so isn’t unheard of. This is an area of divorce especially vulnerable to dirty tricks, and an absolutely critical area to be informed upon.

Remember, lawyers don’t take your divorce personally, this is just business for them. To you, it’s your life

What role does the judge play in a divorce?

Generally it's a "canned presentation" in the divorce court and the judge signs the papers with little thought or contention, it is up to you and your lawyer to make your wants and needs heard.  Don't count on a quiet proceeding during a divorce, occasionally the judge decides to get involved in the issues and expresses his individual attitudes to everyone.

The judge has a lot to say about alimony, property division and custody even if you have worked out an agreement before hand!  He has broad, you might even say huge powers of discretion for the final decision. Learn how to control your court situations in the Divorce Tools, Resources and Tricks manual.

Can't I have an uncontested, amiable divorce and avoid the dirty tricks?

Not unless you are both independently wealthy and have the dispositions of saints.  If you decide to "stand down" in a divorce, you will probably get nothing but heartache and empty pockets. Once the marriage is over, it comes down to who gets what. Even if you plan to be very fair with your ex, you only have a choice after you win. Otherwise, you have to hope he or she will be fair.
